As a matter of fact there are THOUSANDS of ponds across the USA that are 2 feet deep & have Koi in them. As far as depth once you go past 2 feet deep you are classified under the uniform building codes as a swimming pool (hey I dont make the rules) which require you to fence in the property or area of a swimming pool with specific fence & gate requirements. I could go on but it would become a book. LOL
